1. Acceptance of Terms
By accessing or using Skillsapien, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our service. These terms constitute a legally binding agreement between you and Skillsapien.
2. Description of Service
Skillsapien is an AI-powered skill development and career platform that provides online courses, job matching, mentor connections, CV parsing, progress tracking with gamification, and community features. We reserve the right to modify, suspend, or discontinue any part of the service at any time with or without notice.
3. User Accounts
Account Creation
You must provide accurate, complete, and current information. You must be at least 16 years old to create an account. One person or entity may maintain only one account. You are responsible for maintaining the confidentiality of your account credentials.
Account Security
You are responsible for all activities under your account. You must notify us immediately of any unauthorized access. We reserve the right to suspend or terminate accounts that violate these terms.
Account Termination
You may delete your account at any time through account settings. We may suspend or terminate your account for violations of these terms, fraudulent activity, or prolonged inactivity. Upon termination, your access to paid content will cease, and data will be handled per our Privacy Policy.
4. User Conduct
Prohibited Activities
You agree not to: violate any laws or regulations; infringe on intellectual property rights; upload malicious code or viruses; harass, abuse, or harm other users; impersonate any person or entity; scrape or data mine our platform; use the service for unauthorized commercial purposes; create fake profiles or multiple accounts; manipulate gamification systems or achievements; or interfere with platform security or functionality.
Content Standards
User-generated content must be accurate and truthful, respectful and non-offensive, relevant to the platform, compliant with copyright laws, and free from spam or promotional material (unless authorized).
5. Intellectual Property
Our Content
All content, features, and functionality on Skillsapien (including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, page layout, underlying code, and software) are the exclusive property of Skillsapien and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
User Content
You retain ownership of content you upload (CVs, profiles, comments). By uploading content, you grant Skillsapien a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content for providing and improving our services. You represent that you have all necessary rights to your uploaded content.
Trademarks
Skillsapien, our logo, and other marks are trademarks of Skillsapien. You may not use these marks without our prior written permission.
6. Payments & Subscriptions
Pricing
Course prices are listed in USD, AUD, or INR depending on your region. Prices are subject to change with 30 days notice. We offer free, one-time purchase, and subscription-based courses.
Payment Processing
Payments are processed securely through Stripe. We do not store your full credit card information. By providing payment information, you authorize us to charge your payment method.
Refunds
We offer a 30-day money-back guarantee on courses if you are not satisfied, have completed less than 25% of the course, and request a refund within 30 days of purchase. Refunds for subscriptions are prorated based on unused time. Mentor session fees are non-refundable unless the mentor cancels.
Subscription Cancellation
You may cancel subscriptions at any time. Cancellation takes effect at the end of the current billing period. No partial refunds for mid-period cancellations.
7. AI Services & Data Processing
CV Parsing
Our AI-powered CV parsing service uses Claude by Anthropic to extract information from your uploaded CV. By using this feature, you consent to your CV being processed by our AI service provider. Processed data is used to populate your profile and match you with relevant opportunities.
Job Matching Algorithm
Our AI analyzes your skills, experience, and preferences to recommend jobs. Match scores are calculated based on multiple factors and are for informational purposes only. We do not guarantee employment outcomes.
Data Accuracy
While we strive for accuracy, AI-processed information may contain errors. You are responsible for reviewing and correcting your profile information.
8. Third-Party Services
Our platform integrates with third-party services including Stripe (payments), Anthropic Claude (AI processing), OAuth providers (Google, LinkedIn for authentication), and Strapi CMS (blog content). These services have their own terms and privacy policies. We are not responsible for third-party service failures, data breaches, or policy changes.
9. Disclaimers & Warranties
Service "As Is"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
No Employment Guarantee
Skillsapien does not guarantee that you will find employment, get hired, or earn any specific income. Job matches and recommendations are suggestions only.
Course Content
Course content is for educational purposes only. We do not guarantee specific learning outcomes, certifications, or professional advancement.
Platform Availability
We strive for 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance will be announced when possible.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKILLSAPIEN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; (D) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY; (E) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICE; AND/OR (F) USER CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY. IN NO EVENT SHALL SKILLSAPIEN'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO SKILLSAPIEN IN THE LAST TWELVE (12) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify, defend, and hold harmless Skillsapien, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of the service; (b) your violation of these terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any content you submit or transmit through the service.
12. Dispute Resolution
Governing Law
These terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions.
Arbitration
Any dispute arising from these terms shall first be attempted to be resolved through good-faith negotiation. If not resolved within 30 days, disputes will be settled by binding arbitration in Sydney, Australia.
Class Action Waiver
You agree to resolve disputes with Skillsapien on an individual basis and waive the right to participate in class actions or class arbitrations.
13. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of material changes via email or platform notification at least 30 days before changes take effect. Continued use of the service after changes constitutes acceptance of the modified terms. If you do not agree to the changes, you must stop using the service and may delete your account.
